Wrongful Death

At the Honolulu law office of Rosenberg McKay Hoffman, you will find experienced lawyers who will handle your Hawaii personal injury case personally and professionally, including cases of wrongful death and serious injuries resulting from car accidents or other cases of negligence. Our firm handles wrongful death and serious injury cases arising out of all the following situations:

Wrongful Death

When the negligence or misconduct of another causes death rather than just serious injury, the family members of the deceased may bring an action for wrongful death to recover damages suffered by the family members. These damages include direct expenses and economic damages such as funeral and burial expenses and the loss of income to the family from the death of a wage-earner. Family members may also recover for the loss of companionship they must endure, whether it is the missing affection of a spouse, the training and guidance of a parent, or simply the close relationship of a loving companion.

Wrongful death cases are often more difficult prove than other cases of personal injury, since the injured person is not available to explain what happened. However, with our decades of experience handling car accidents and other personal injury cases, we have particular knowledge and skill in the areas of accident investigation and reconstruction and are capable of handling these cases for the benefit of the family members bereft of their loved one.

Serious Injuries

Many of the serious accidents mentioned above, when not fatal, result in catastrophic, serious injuries, including traumatic brain injury (TBI), spinal cord injury, burn injuries and the loss of a limb or amputation. Serious injuries are obviously more expensive than other injuries, with more expensive and extensive treatment required for emergency and acute care, as well as a lengthy period of rehabilitation.

Besides medical expenses, there are many additional costs that must be considered. TBI and spinal paralysis, such as paraplegia or quadriplegia, and the loss of a limb are permanent disabilities, requiring long-term care and additional challenges for a lifetime. Modifications may be required to the home and car; self-care may even be impossible, requiring a full-time caregiver or residence in a nursing home or long-term care facility. Prosthetics will need to be replaced several times over a lifetime, and medical complications are likely in many cases. Then there is the emotional trauma of the injury and the coping required to live with a disability.

Not every personal injury attorney has handled cases involving such serious injuries, and not every personal injury lawyer knows how to identify, quantify, and present all the damages in a serious injury case. By trusting your case to an inexperienced attorney, you run the risk of shortchanging yourself when it comes to recovering compensation for all the damages you have incurred. At Rosenberg McKay Hoffman, our attorneys have over 50 years combined experience in the practice of law. We know how to prepare and present a serious injury case, and we take the time to do it right.
